General Terms and Conditions

  1. The details contained in our offers are based on information provided to us. We are making every effort to ensure that the details concerning Objects and Contractors are as complete and correct as possible; however, we cannot accept any liability for the correctness and completeness of the latter.

    We accept liability for damage arising from injury to life, body or health resulting from negligent breach of duty on the part of the Real Estate Broker and for other damage resulting from grossly negligent breach of duty on the part of the Real Estate Broker, its legal representatives or its vicarious agents only.

  2. Our notifications are not binding; subject to prior sale and letting and/or leasing.

  3. We are also entitled to become active on behalf (subject to payment of commission) of the Counter Party.

  4. Our offers and notes are intended for the recipient only. They shall be treated confidentially and must not be disclosed to third parties. If a contract is concluded as a result of unauthorised disclosure, our Mandator shall be obliged to pay the full amount of the commission that would have been payable upon successful conclusion.

  5. If the recipient has already been aware of a given opportunity to conclude a contract provided by us, he / she shall notify us immediately and, upon request, furnish proof thereof.

  6. Our entitlement to commission shall arise as soon as a contract has been concluded as a result of our notification or through our commercial agency. The latter imposes the duty to notify us immediately, if an object offered by us resulted in a contract conclusion and, if applicable, the conditions thereof.

  7. The entitlement to commission shall also arise if the contract is concluded at conditions that deviate from our offer or if contractual amendments and supplements will be concluded, if and to the extent of which they are connected in time and economic terms. The entitlement to commission shall also arise, e.g., if a sales contract instead of a lease or a hereditary building right contract instead of a sales contract is concluded in connection with the object and vice versa.

  8. Unless otherwise agreed upon in writing, the commission for notification or brokerage shall amount to:

    - for renting and letting real estate 2.38 net monthly rents incl. statutory VAT.
    - for purchasing and selling real estate 3.57% of the purchase incl. statutory VAT.

  9. The entitlement to commission shall continue even if the concluded contract has expired due to resolutory conditions. The same shall apply if the contract will be resolved due to a reservation of the right to terminate the contract on the part of the Mandator or if it will be rescinded and/or not performed due to any other reasons based upon the latter. In the event of successful contract avoidance, the contracting party that caused the ground for avoidance shall be obliged to pay damages.

  10. If permitted by law, the place of performance and jurisdiction shall be our registered office in Berlin.
